Društveni identitet i pravni subjektivitet – kolektiviteti kao subjekti prava?

Apstrakt

Ovaj rad nastoji da pokaže da pravnoteorijsku obradu pitanja koje se tiče promovisanja izvesnih kolektivnih entiteta u status titulara prava nije moguće na zadovoljavajući način izvršiti unutar metodoloških obrazaca bilo Hartove analitičke jurisprudencije, bilo Kelzenove Čiste teorije prava. Pokazuje se da je pitanje konceptualizacije kolektivnih prava u dobroj meri pitanje opravdavanja, a ne pukog analiziranja ili opisivanja. U tom smislu, ovaj rad je fokusiran na rasvetljavanje različitih aspekata problema pravnog oblikovanja društvenog identiteta relevantnih kolektiviteta u svrhu konstrukcije pravnog subjektiviteta. U prvom delu se u kratkim crtama pokazuje da je pitanje pravnog subjektiviteta generalni problem sa kojim se suočava pravna teorija i da, otuda, nema ničeg specifično novog u vezi sa kolektivitetima kao potencijalnim titularima prava. Drugi deo rada posvećen je podrobnijem razmatranju društvene i pravne „konstrukcije različitosti“, na kojem je zasnovan koncept kolektivnih prava. Krajnji zaključak je da pravna teorija kolektivnih prava ove zadatke teško može obaviti bez oslona na metodološki aparat kako sociološke, tako i antropoloških disciplina.
